Terms of Use

These Terms govern access to and use of the Lex Gazette website, authenticated Legal Notice reader, source-linked records, authentication outcomes, search tools and related services (collectively, the Service). By creating an account or using protected material, you agree to these Terms.

1. Service provider and contact

The Service is operated by Mmamoage Information Systems (Pty) Ltd. Registration number: 2024/312397/07. Address: 714 Van Alphen Street, Montana, 0182. Service and privacy contact channels are listed in the Privacy Notice.

2. Independent legal research service

Lex Gazette is an independent, source-linked legal research service. It is not the Government Printing Works, a court, the Master of the High Court, the Companies and Intellectual Property Commission, or another official registry. The official Government Gazette and relevant official registry remain the authoritative sources.

The Service does not provide legal advice, representation, a legal opinion, a credit report or an identity warranty. Users remain responsible for professional judgment, source verification and compliance with duties applicable to their role.

3. Eligibility and account information

Protected access is intended for adults acting for a lawful legal, fiduciary, insolvency, compliance, due-diligence, risk-management or bona fide research purpose. You must provide accurate account information, keep it current, use an email address you control and promptly notify the Service of unauthorised use or a suspected security incident.

Accounts are personal. You may not share credentials, allow another person to use your account, create accounts by automated means or circumvent an access control.

4. Permitted professional use

You may search, review, cite and use records to the extent reasonably necessary for your stated lawful professional purpose. You must preserve source context and, before taking legal, regulatory or commercial action, verify material against the cited Gazette and any relevant official registry or primary record.

Limited extracts may be used in professional work where lawful, necessary and appropriately secured. Any wider publication, distribution or creation of a separate dataset requires an independent lawful basis and, where applicable, written permission for Lex Gazette's original compilation, annotations and authentication outputs.

5. Prohibited conduct

• Identity fraud, impersonation, harassment, intimidation, doxxing or unlawful surveillance.
• Unsolicited direct marketing, unrelated profiling or decisions based on excessive or irrelevant personal information.
• Bulk scraping, automated harvesting, systematic downloading, reverse engineering of access controls or use of another person's credentials.
• Public republication of complete identifiers or identifiable Gazette records without a documented lawful basis.
• Creation or enrichment of an unrelated personal-information database.
• Misrepresentation of an authentication outcome as an official determination, legal advice or a guarantee of current status.
• Any use that infringes law, professional duties, court rules, confidentiality obligations or the rights of another person.

6. Personal information and responsible use

Your use of identifiable records is subject to the professional and POPIA responsible-use attestation. You must apply purpose limitation, minimality, security and appropriate retention to information obtained from the Service. The attestation supplements these Terms; it does not transfer the Service provider's statutory obligations to you.

7. Source fidelity and authentication outcomes

Lex Gazette preserves the published source and distinguishes it from normalized or authenticated fields. An authentication result records a source-linked research outcome at the time it was produced. Labels such as “authenticated”, “fixed and authenticated”, “unauthenticated” or “review required” must be read with the cited source and methodology.

Gazette text may contain publication, extraction or source-data errors. A normalization or proposed fix may be rejected or revised. You must not conceal a source discrepancy or present a normalized value as though it was the verbatim publication.

8. Corrections, objections and restrictions

Suspected errors, misidentification or misuse should be reported through the corrections or privacy channel. The Service may investigate, annotate, restrict, correct, replace, supersede or withdraw a record or release while preserving evidence necessary for accountability and source integrity. A correction to Lex Gazette does not amend the official Gazette.

9. Intellectual property

Public Gazette material remains subject to the rights and legal status applicable to that official material. Lex Gazette retains rights in its original selection, structure, interface, compilation, normalization, annotations, authentication outputs, methodology and software, to the extent permitted by law. No licence is granted except the limited right to use the Service under these Terms.

10. Availability and changes

The Service may be maintained, updated, corrected or temporarily unavailable. Features, releases and access arrangements may change. Reasonable efforts will be made to preserve source integrity and auditability, but uninterrupted availability and complete error-free operation are not guaranteed.

11. Fees and subscriptions

Where a paid plan is introduced, the applicable price, term, usage limits, renewal and cancellation arrangements will be disclosed before purchase or agreed separately. These Terms do not by themselves create a payment obligation.

12. Disclaimers and reliance

The Service is supplied as a professional research aid. Nothing excludes a right or remedy that cannot lawfully be excluded. Subject to that qualification, the operator does not warrant that every record is complete, current or suitable for a user's particular matter. Users are responsible for independent verification and for decisions made using the Service.

13. Account suspension and termination

Access may be limited, suspended or terminated where reasonably necessary for security, suspected misuse, breach of these Terms, an expired or withdrawn entitlement, a lawful objection or restriction, non-payment under a future paid plan, or a requirement imposed by law or a competent authority. Where appropriate, the operator may preserve records needed for investigation, proof, legal hold or regulatory obligations.

14. Policy changes and re-attestation

Material changes are issued as a new version with an effective date. Existing signed-in users may be required to review and accept revised Terms before protected Gazette material is released. The policy version register identifies current and archived versions.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute process and court jurisdiction remain subject to applicable law and any mandatory rights that cannot be waived.
